Well first offense DUI, there is a possibility of losing it up to 120 days. The first thing you have to do to prevent the state from taking your license is request a hearing with the driver’s license division. They’ll schedule a hearing and that hearing has to be scheduled within 30 days of the DUI citation. If you go to the hearing, the officer shows up, puts on testimony; indicates the reasons why he stopped you, why he pulled you over, how you did on the field sobriety test. Then the attorney — myself — would question him and ask him specific questions about all of those issues

There is a possibility that you could lose it for 120 days on the first offense. But if you do lose your license, there are things that we can do in court to get that reduced and cut in half.
